Die Umsetzung der DigiRL in Deutschland schreitet voran: Die Bundesregierung hat am 10. Februar 2021 den Regierungsentwurf für das Gesetz zur Umsetzung der Digitalisierungsrichtlinie (DiRUG) (BR-Drs. 144/21) beschlossen.
Ungeachtet einer ganzen Reihe primär „technischer“ Änderungen entspricht der Regierungsentwurf weitestgehend dem Referentenentwurf vom 18. Dezember 2021 (dazu ECCL-Blog vom 18. Dezember 2021 = NZG 2021, 92 = EuZW 2021, 43 sowie J. Schmidt ZIP 2021, 112 ff.; Knaier GmbHR 2021, 169 ff.).
Eine begrüßenswerte inhaltliche Änderung gibt es aber z. B. in Bezug auf die Identifizierung der Beteiligten im Rahmen der Beurkundung mittels Videokommunikation (§ 16c BeurkG-E): Der zusätzlich zum elektronischen Identifizierungsmittel erforderliche Abgleich mit einem Lichtbild kann nun auch aufgrund eines Passes erfolgen. Zudem kann im Musterprotokoll für die Gründung mittels Videokommunikation nun auch eine gemeinschaftliche Vertretung eines Geschäftsführers mit einem Prokuristen vorgesehen werden.

The implementation of the DigiD in German progresses: On 10 February 2021, the German government adopted the government draft for Gesetz zur Umsetzung der Digitalisierungsrichtlinie (DiRUG) [Law to implement the Digitalisation Directive] (BR-Drs. 144/21) .
Despite several primarily „technical“ amendments, the government draft largely corresponds with the ministerial draft of 18 December 2021 (on this see ECCL-Blog of 18 December 2021 = NZG 2021, 92 = EuZW 2021, 43 and J. Schmidt ZIP 2021, 112 ff.; Knaier GmbHR 2021, 169 ff.).
But there is, for example, a welcome material amendment with respect to the identification of the parties in the context of notarisation via videocommunication (§ 16c BeurkG-draft): For purposes of comparison with a photograph – which is required in addition to an electronic identification means– it is now also possible to use a passport. Moreover, in the template for online formation, it is now also possible to provide for joint representation by a "Geschäftsführer" (director) and a “Prokurist” (authorized officer).
