Nachdem am 5. Februar 2019 bereits eine Einigung über das Digitalisierungspaket erzielt worden war (STATEMENT/19/867), haben sich Rat und Europäisches Parlament am 13. März 2019 nun auch über das Mobilitätspaket geeinigt (STATEMENT/19/1608).
Die beiden Richtlinien zur Änderung der GesRRL (DigiRL und MobilRL) müssen nun nur noch formell verabschiedet und im Amtsblatt veröffentlicht werden; anschließend müssen sie von den Mitgliedstaaten umgesetzt werden.
Das Company Law Package hat den rechtspolitischen „Wunschzettel“ zwar nicht komplett erfüllt, zudem sind einige der neuen Regelungen im Detail nicht unbedingt optimal. Nichtsdestotrotz bedeutet es einen entscheidenden Meilenstein für die Harmonisierung des Gesellschaftsrechts in Europa und wird sowohl die Digitalisierung als auch die grenzüberschreitende Mobilität von Gesellschaften in Europa um Quantensprünge voranbringen.

After an agreement on the digitalisation package was reached on 5 February 2019 (STATEMENT/19/867), the Council and the European Parliament have now reached an agreement on the mobility package on 13 March 2019 (STATEMENT/19/1608).
The two directives to amend the CLD (DigiD) and (MobilD) now only have to be formally adopted and published in the Official Journal; subsequently, they will have to be implemented by the Member States.
The Company Law Package has not completely fulfilled all desiderata in terms of legal policy; moreover, some of the new rules are not optimal in detail. Nonetheless, it constitutes a pivotal milestone for the harmonisation of company law in Europe and it will substantially advance both digitalisation and cross-border mobility of companies in Europe by way of a real quantum leap.
